In the judicial practice of the Republic of Armenia, a stable practice of providing compensation to persons acquitted in criminal proceedings has gradually formed. About two years ago, our client R.P., who was acquitted in a criminal case, had been in custody for about 40 days, and for several months, a preventive measure of a ban on absences was applied. In addition, a search was conducted in his home, thereby restricting his right to inviolability of the home.
The Court of General Jurisdiction of the First Instance of Yerevan, chaired by Judge Tigran Grigoryan, decided to recover 1,100,000 AMD from the Republic of Armenia as compensation for the restoration of R.P.'s violated rights (see civil case No. ED/45347/02/21). It is noteworthy that the court has also set monetary compensation for damage caused by restricting the right to inviolability of a person's home.
