Thanks to the efforts of our lawyers, the acquitted defendant will also receive compensation for 677 days of detention

In the judicial practice of the Republic of Armenia, a stable approach has gradually developed regarding the provision of compensation to individuals acquitted in criminal proceedings. Nearly four years ago, our client A.Gh., who was acquitted, had been held in detention for 677 days; in addition, a search had been conducted at his home.

The Yerevan Court of General Jurisdiction, presided over by Judge Ashot Hovhannisyan, decided to recover 2,200,000 AMD from the Republic of Armenia as compensation for the violation of A.Gh.’s rights. Of this amount, 2,000,000 AMD was awarded for the violation of his right to liberty, and 200,000 AMD — for the violation of the inviolability of his home (see Civil Case No. ЕD/66453/02/22).

Although we believe that the amount of compensation awarded for the violation of the right to liberty does not correspond to the nature of the violation — and we have appealed this decision to the Court of Appeal — we would nevertheless like to thank Judge Ashot Hovhannisyan for issuing a valuable judicial act contributing to the development of judicial practice in restoring individuals’ violated rights in criminal proceedings.
