The Court of General Jurisdiction of the first instance of the city of Yerevan rejected the claim in the civil case no.ED/0011/02/21 in connection with the expiration of the statute of limitations, arguing that the statute of limitations expired at the time of submitting a petition to change the subject of the claim.
Based on the appeal of lawyer Edgar Ayvazyan, the Civil Court of Appeal overturned the decision of the court of first instance and sent the case for a new hearing in full, arguing that the court of first instance rightfully allowed the change of the subject of the claim, and if the amended claim is intended to protect the same right as the original claim, then it cannot to talk about the expired statute of limitations.
